1. Acceptance of Terms

By creating an account or otherwise accessing Jobfoto, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement. Continued use of the Service constitutes acceptance of these Terms and any future updates.

2. Description of Service

Jobfoto is an AI-powered platform that generates professional headshots from your photos. You upload a few selfies, we process them with a personalized AI model, and generate headshots in a variety of styles (outfit, background, pose). The whole process typically takes ~15 minutes.

3. Image Rights and Licensing

You retain full ownership of all photos you upload. By uploading, you grant us a limited license to process them for generating your headshots. This license ends when you delete your data or close your account.

You own all generated headshots and may use them for any lawful purpose, including commercial use.

By uploading photos, you warrant that you are the person depicted (or have explicit consent from all depicted individuals), that all individuals are at least 18, and that the photos do not violate any third-party rights. You agree to indemnify us against any claims arising from a breach of these warranties.

4. Service Performance and Availability

We strive to provide reliable service but cannot guarantee uninterrupted availability, specific processing times, or particular output quality. Processing typically takes ~15 minutes but may vary.

Generated headshots are created by AI and may not perfectly represent you. Results vary based on the quality of your uploaded photos. Professional and Executive plans include 1 free retry, allowing you to upload new photos and regenerate your headshots at no additional cost if you are not satisfied with your initial results.

5. Intellectual Property Rights

All content, design, trademarks, and proprietary features of Jobfoto are owned by us or our licensors and are protected under applicable copyright and trademark laws. You may not reproduce, distribute, modify, or resell any portion of the Service without prior written consent.

You retain ownership of your uploaded photos and generated headshots as specified in Section 3.

6. Prohibited Content and Use

You may not upload or use the Service to create:

• Photos of individuals other than yourself without their explicit consent
• Photos of minors (individuals under 18 years of age)
• Photos containing nudity, sexual content, or explicit material
• Photos of public figures, celebrities, or politicians for impersonation purposes
• Photos intended for fraudulent, deceptive, or illegal purposes
• Photos that violate any third-party intellectual property rights

You also agree not to:

• Use the Service for unlawful or fraudulent purposes
• Attempt to breach or test our security systems
• Scrape, crawl, or harvest data via automated methods without authorization
• Interfere with the proper operation of the Service

We reserve the right to review uploaded content, reject processing requests, and terminate accounts that violate this policy.

7. Payments and Credits

Jobfoto offers paid plans that include headshot generation, editing credits, and upscaling. You can also purchase additional credit packs separately. By purchasing a plan or credits, you agree to pay all applicable fees as displayed at checkout. Payments are processed securely through Stripe.

Credits are non-transferable, have no cash value, and are not refundable. If an operation fails, the credits spent are automatically returned to your balance.

Since our service delivers personalized digital content, processing begins immediately upon purchase. By placing an order, you expressly consent to this and waive your right of withdrawal once processing has started.

Plan refunds are handled according to our refund policy.

8. Limitation of Liability

To the maximum extent permitted by law, Jobfoto shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of business opportunities, reputational harm, or dissatisfaction with AI-generated image quality arising from use of the Service.

Our total liability to you for any claim arising from these Terms or use of the Service shall not exceed the amount you paid us in the 12 months prior to the claim.

9. Modifications and Updates

We may update these Terms or modify the Service from time to time. We will notify you of material changes via email. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of Switzerland. Any dispute shall be resolved in the competent courts of Zürich, Switzerland, unless otherwise required by law.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced with a valid provision that most closely reflects the original intent.
